Exit Management, Entitlements, and Separation Procedures

This Regulation establishes the framework for managing exit from the civil service within the Jubbaland State public sector, including retirement, resignation, and termination of employment due to redundancy. It defines the procedures, entitlements, and administrative responsibilities required to ensure orderly, fair, and transparent separation processes.

Application extends to civil servants funded through the consolidated government budget, including those supported through donor-funded positions, while excluding categories such as security forces, judiciary members, and political office holders. The framework ensures that workforce transitions are managed in alignment with institutional needs and legal requirements.

Retirement is governed through clearly defined provisions. Mandatory retirement is set at the prescribed age, with advance notice issued to affected employees. Retirement benefits include a lump sum payment calculated based on length of service, alongside payment for any accrued but unused annual leave. Provisions also address early retirement on medical grounds, subject to independent medical assessment and formal approval.

Resignation procedures require formal written notice within a defined timeframe. Resigning employees are not entitled to severance benefits but receive payment for any accrued leave. Administrative processes ensure accurate calculation and settlement of outstanding entitlements prior to separation.

Termination due to redundancy is applied where positions are no longer required due to organisational restructuring, closure of functions, financial constraints, or changes in operational priorities. Employees affected by redundancy are provided with notice and may be considered for redeployment to suitable alternative positions where available.

Where redeployment is not possible, affected employees are entitled to compensation calculated based on years of service, in addition to payment for accrued leave. Redundancy processes require formal approval and must be justified through documented organisational changes, ensuring that decisions are transparent and evidence-based.

Provisions also address situations involving death in service, with entitlements payable to the employee’s dependants based on length of service and outstanding benefits.

Clear administrative procedures govern calculation, verification, and payment of all entitlements, requiring coordination between human resource units, the Civil Service Commission, and the Ministry of Finance. Records must be updated to reflect changes in employment status, ensuring accuracy in payroll and personnel systems.

Mechanisms for complaints and appeals allow affected individuals to challenge decisions related to separation, ensuring fairness and accountability throughout the process.
