Civil Service Appeals Regulation (No. 2)
This Regulation establishes the framework for submitting, reviewing, and resolving appeals within the Jubbaland State civil service. It ensures that civil servants have access to a fair, transparent, and structured mechanism to challenge decisions affecting their employment, rights, or conditions of service.
The framework applies to civil servants funded through the consolidated government budget, with defined exclusions for categories such as security forces, judiciary members, and political office holders. Clear scope and definitions support consistent application across public institutions.
A two-tier appeals process forms the core of the framework. The first level involves an internal review conducted by the Civil Service Commission, where an appeal must be submitted within a specified timeframe and supported by justification. A second level provides for escalation to an independent Appeals Board if the outcome of the internal review is not satisfactory.
The internal review process requires that appeals be assessed by a Commission member not involved in the original decision. The Commission is empowered to investigate matters, request additional information, and issue corrective actions where necessary. Remedies may include reinstatement, reversal of administrative decisions, removal of disciplinary measures, or directives for institutional improvements.
An independent Appeals Board is established to ensure impartiality in the second stage of review. The Board is composed of members selected for their expertise and representation, including government officials, labour representatives, and individuals with relevant professional or legal experience. Independence, neutrality, and fairness are central to its functioning.
Appeals must be submitted in writing and supported by relevant evidence. The process allows for flexibility, including extensions in justified cases, written reviews, or formal hearings where necessary. Representation is permitted, and confidentiality is maintained throughout the process.
The Appeals Board is vested with authority to summon information, hear witnesses, and make binding decisions. Outcomes may confirm, overturn, or modify the original decision, including ordering appropriate remedies. Decisions are final and enforceable, subject only to judicial review through the courts.
Time-bound procedures guide each stage of the process, ensuring that appeals are handled efficiently while maintaining due process and procedural integrity.
